Appeal Procedure

 

A. Appeal Procedure. An appeal of a parking violation notice (PVN) must be filed with the Department of Public Safety within fifteen (15) calendar days of issuance of the PVN. Appeal forms are available at the Department of Public Safety office and may be picked up during normal business hours Monday through Friday. Failure to file the written appeal within the fifteen (15) calendar days from the issuance of a PVN will result in the forfeiture of all appeal rights related to such PVN.

 

B. Effect of Appeal. All appeals will be presented to the CSM parking referee, who shall be appointed by the President of CSM. The referee shall conduct an impartial review of the facts and circumstances surrounding the issuance of the PVN and issue a decision regarding the appeal. The referee may uphold the PVN, reduce the fine attached to the PVN or void the PVN. If the referee determines the appeal was frivolous the fine shall be increased to twice the original fine. The decision of the referee is binding upon both the appellant and the CSM Department of Public Safety. There is no further appeal. The parking appeal referee will notify the appellant by first class mail of the referee’s decision. The notification will be sent to the appellant’s last known address. The notification will be considered to have been delivered three business days from the date of mailing.
