Residency Classification in Colorado

Residency petition requirements and submission deadlines are subject to change without notice. The information on this page is considered to be general guidance and is not legal advice. Refer to state statutes to view the actual law. Tuition classification is governed by state law (Title 23, Article 7, of the Colorado Revised Statutes of 1973, as amended) and by judicial decisions that apply to all public institutions of higher education in Colorado, and is subject to change at any time. The university is not free to make exceptions to the rules except as specifically permitted by state law.

Regardless of how long a student has been in Colorado, being in the State on a temporary basis for the purpose of an education is not enough to gain residency status. Furthermore, after a student is enrolled at an institution, their classification for tuition purposes remains unchanged in the absence of clear and convincing evidence to the contrary. Domicile & Intent:

The following is considered evidence of domicile and intent, although no single factor alone is conclusive. It is important to refer to the appropriate petition to determine what evidence you need to provide.

Evidence showing domicile (permanent home):

  • Ownership of residential property in Colorado for 12 or more months (must be permanently living in the residential property)
  • Lease agreements for 12 or more months

Petition Deadlines:

Deadlines for each term will always be on the dates listed below. Petitions can be submitted as early as two months prior to the deadline and petition review will begin one month prior to the deadline. Late petitions will NOT be accepted.

Petition Process:
  • Petitions can be found HERE. Once directed to the webpage, click on the applicable ‘Qualified Petitioner’ to locate the form.
  • Petitions should be emailed to residency@mines.edu.
  • Students will receive a confirmation email when their petition has been received. This will include an estimated time of when they can expect a decision.
  • Petitions are reviewed in the order they are received and can take 4 or more weeks.
  • Students should check their Mines email regularly as this will be the main source of communication if additional documentation is needed or once a decision has been made.
  • Pdf is acceptable and preferred. If possible, submit documentation as one single file. Other files accepted: zip, google drive, shared drive (please allow access to review files).
  • Files can be encrypted. Be sure to email the password in a separate email.
  • SSNs can be redacted.
  • Or you can drop off or mail your petition to:

  • If a petition is paper and mailed or dropped off this can delay review time as we scan all paper documents to our system before we review.

If you are a newly admitted student at Mines, and classified as non-resident, DO NOT petition. You must complete a Tuition Classification form with the Office of Admissions. For more information please contact admissions@mines.edu.
